Terms and conditions
Last updated: TODO — set the publication date
These are the terms on which Bramble Hill Nursery provides work. They are written to be read, not to be skipped.
WRONG DOCUMENT — do not publish. This scaffold is written for a business that quotes for one-off jobs. Bramble Hill Nursery needs a childcare agreement — fees and funded hours, notice periods, settling-in, sickness and exclusion, who is authorised to collect a child, and your safeguarding position. None of that is in the scaffold below, and the sections about quotes and site access do not apply to you.
SPECIALIST ADVICE NEEDED — You care for or work with children. That brings obligations a generic notice cannot cover: children's personal data attracts stronger protection, you will hold safeguarding records, and if you are Ofsted registered you have retention rules set by the EYFS framework rather than by choice. Do not publish a generic privacy notice — have one written for an early years or education setting.
TODO — set payment terms, confirm any guarantee you offer, choose your governing law, and have this reviewed before you rely on it.
1. Who we are
These terms are between you and Bramble Hill Nursery. Our full details are at the foot of every page.
2. Quotes and estimates
A quote is a fixed price. We will honour it. An estimate is our best assessment of a job we cannot see the whole of yet — it can change, and if it is going to, we will tell you before doing the extra work, not afterwards on the invoice.
We will always make clear which one we are giving you.
3. Prices and VAT
TODO — state whether your prices include or exclude VAT, and whether you are VAT registered. Prices shown to consumers must include VAT.
4. Your right to cancel
If you agreed to this work in your own home, or at a distance — by phone, email or through our website — you normally have 14 days to change your mind and cancel, without giving a reason. This is your right under the Consumer Contracts Regulations 2013.
To cancel, just tell us — a phone call, email or letter is fine. If you have already paid, we will refund you within 14 days of being told.
If you want us to start sooner
Sometimes a job cannot wait 14 days. If you want us to begin inside the cancellation period, we will ask you to confirm that in writing. If you then cancel, you still can — but you will be asked to pay for the work already done up to that point.
If the work is fully completed within the 14 days at your request, the right to cancel ends once it is finished.
TODO — make sure your actual booking process captures this request in writing. If it does not, you cannot charge for work done by a customer who cancels — this is the single most common way trades lose money on this rule.
5. Payment
TODO — set your terms — deposit or not, when the balance is due, how many days to pay, and what happens if an invoice is late.
6. What we need from you
We need access at the agreed time, and accurate information about the job. If we arrive and cannot get access, or the job turns out to be materially different from what was described, we may need to rearrange and charge for the wasted visit — we will tell you in advance if that is going to apply.
7. The standard of our work
Under the Consumer Rights Act 2015 we must carry out our work with reasonable care and skill, within a reasonable time and for a reasonable price where one was not agreed in advance. Nothing in these terms takes those rights away from you.
TODO — describe any guarantee or warranty you offer on workmanship and on parts, and how long it lasts. If you offer none, say so plainly rather than staying silent.
8. If something goes wrong
Tell us. We would far rather fix a problem than have you unhappy. Contact us using the details at the foot of this page and we will respond promptly.
TODO — if your trade body or registration scheme provides a complaints or dispute service, name it here and link to it. Customers find this reassuring and some schemes require it.
9. What we are responsible for
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
We are not responsible for losses that were not foreseeable. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
10. General
TODO — choose one — these terms are governed by the law of England and Wales, or the law of Scotland — and say which courts have jurisdiction.
If any part of these terms turns out to be unenforceable, the rest still applies.
